1.1 Agreement to Terms

By accessing this website, you confirm you are 18+ years old (or legal age in your jurisdiction). Purchasing Digital Artworks occurs exclusively on third-party marketplace platforms like OpenSea. You are responsible for reviewing and complying with their terms of service and applicable laws. You confirm that:

• You are 18+ years old (or legal age in your jurisdiction)
• You understand these are digital art collectibles only
• You accept all risks associated with blockchain technology
• You comply with all local laws regarding digital assets

2.1 Nature of Digital Artworks

You are purchasing a unique, collectible piece of Digital Artwork (an "NFT"). You are not purchasing a security, investment product, membership, or any form of financial instrument.

2.2 Technical Infrastructure

The Crystal Jewel Gems collection operates on an ERC-721 smart contract deployed via OpenSea's Creator Studio.

• Royalty Implementation: The contract includes ERC721-C standard royalty support (3% on secondary sales), which is enforced on marketplaces that support this standard.

2.3 Collection Specifications

The Crystal Jewel Gems collection consists of a maximum of 7,963 unique digital artworks. The artworks are available for minting during a limited period of 6 months, starting on December 17, 2025 and ending on June 17, 2026. Only artworks minted during this period will become part of the permanent collection.

CJ retains ALL copyright and intellectual property rights to all digital artworks, branding, and creative content.

4.1 Right to Resell

Digital Artwork owners have the right to resell their artwork on any Ethereum-compatible marketplace.

4.2 No Approval Required

No approval from ILBADILL 9•6•3 is required for secondary market transactions. The smart contract automatically enforces royalties.

4.3 No Buyback Obligation

ILBADILL 9•6•3 has no obligation to repurchase artworks at any price.

5.1 Blockchain Transactions

All purchases occur on external, non-custodial NFT marketplaces. I do not control these platforms or transaction execution.

5.2 No Refunds

All sales are final due to digital nature and blockchain immutability.

5.3 Royalties

3% royalty on secondary sales supports the artist's ability to continue creating digital art. This is a direct support mechanism for the independent artist.

5.4 Technical Responsibility

I implement reasonable security measures including HTTPS encryption, secure hosting. However, i cannot guarantee protection against all possible threats. You are responsible for maintaining the security of your wallet and private keys.

6.1 Separate Social Space

The project maintains a Discord server as a separate, independent forum for discussing art, mythology, and philosophy. Complete community rules, guidelines, and disclaimers are available in our Community Guidelines.

6.2 No Connection to Digital Artwork Value

Discord access has zero financial value, is not transferable, and does not enhance or affect Digital Artwork value in any way.

6.3 By participating in our Discord

You agree to our Community Guidelines and acknowledge it is a separate, voluntary social space that may be modified or discontinued at any time.

You agree NOT to:

• Misrepresent Digital Artworks as investments or financial products
• Use artwork for illegal or harmful purposes
• Reverse engineer or modify the artwork
• Impersonate the project or the artist
• Engage in market manipulation or fraudulent activities

7.1 Compliance with International Sanctions

You represent that you are not located in, or a resident of any country subject to international sanctions. All sales occur via third-party platforms that enforce their own compliance measures. You are solely responsible for ensuring your participation complies with all applicable laws in your jurisdiction.

8.1 "As Is" Basis

The website and Digital Artworks are provided "as is" without any warranties.

8.2 No Guarantees

I disclaim all warranties including merchantability, fitness for purpose, and non-infringement.

8.3 Third-Party Services

I are not responsible for blockchain networks, wallets, or marketplace platforms.

9.1 No Liability

To the maximum extent permitted by law, ILBADILL 9•6•3 shall not be liable for any damages.

9.2 Damages Exclusion

This includes direct, indirect, incidental, special, or consequential damages.

9.3 Maximum Liability

To the extent permitted by applicable law, our total liability shall not exceed the amount you paid for the specific artwork. This limitation does not affect your statutory rights as a consumer under Portuguese or EU law.

9.4 Acknowledgment of Risk

You expressly acknowledge and agree that you assume full responsibility for all risks associated with acquiring and holding the Digital Artwork as a collectible. Any purchase is made entirely at your own risk.

9.5 Consumer Protection Rights

Nothing in these Terms is intended to exclude or limit liability for gross negligence, willful misconduct, death, or personal injury caused by our actions, or any other liability which cannot be excluded or limited under mandatory provisions of applicable law, particularly mandatory Portuguese consumer protection law and the laws of the consumer's country of residence within the European Union.

You agree to indemnify ILBADILL 9•6•3 only for claims directly resulting from your material violation of these Terms or unauthorized use of the artwork.

11.1 Governing Law

These Terms are governed by Portuguese law. As an independent artist based in Portugal, this reflects our location and operational base.

11.2 Dispute Resolution

For any disputes, we prefer to resolve matters amicably through direct communication at legal963ilbadill@gmail.com.

If formal proceedings are necessary, they will be conducted in the competent courts of Portugal. EU consumers maintain their rights under EU consumer protection laws.

I may update these Terms. The updated version will be effective as of the date it is posted. Your purchase of a Digital Artwork is governed by the Terms in effect at the time of that purchase. For ongoing use of the website or community access, your continued use after changes constitutes acceptance.

If any provision is invalid, the remaining provisions remain in effect.
